1. Publisher, scope and agreement
These Terms of Use govern the website and services provided by SHLAEN RETAIL LLC, the publisher of Smart World Journal. References to the journal, we or us mean that company. Named editors, reviewers and board members are not personal guarantors of the publisher’s obligations merely because they are identified on the site. This provision does not release any person from liability imposed by applicable law. When a form presents these terms for electronic acceptance, your affirmative checkbox relates to that submission or request. Merely viewing a page is not represented as an electronic signature to every contractual clause. The Privacy Policy explains data practices; manuscript rights are additionally governed by the Author Submission and Publication Agreement.
2. Eligibility and authority
To submit forms or enter an agreement, you must be at least 18 and legally able to do so, or act through a legally authorized arrangement accepted by the publisher. Use your correct publication or professional identity and a working contact address. If you act for coauthors, an institution or a rights owner, you represent that you have the authority you claim; we may require separate confirmation. Access, a receipt or an automated email does not verify credentials or establish appointment, acceptance or endorsement.
3. Permitted use and intellectual property
You may read, link to and cite material and exercise fair use or other applicable legal rights. Rights in individual articles, photographs, diagrams, software, trademarks and other material remain with their respective owners or are governed by the licence expressly identified for that material. Free access does not by itself grant unrestricted republication or commercial reuse. No Creative Commons licence is implied where none is stated. The publisher grants no rights it does not hold. Do not circumvent security or rate limits, interfere with the service, impersonate others, harvest contact details for unsolicited marketing, or upload unlawful, malicious or unauthorized material. These restrictions do not prohibit lawful research, reporting, criticism or rights requests.
4. Nature of scholarly and news content
Articles, news briefings, proposed methodologies and expert opinions are informational publications. They are not site-specific engineering designs, building approvals, professional certifications, medical or legal advice, financial recommendations or a substitute for a qualified professional’s assessment. Readers must evaluate source limitations and obtain appropriate independent advice before acting in a safety-critical or regulated setting. Conceptual proposals, computational examples and retrospective briefings must be interpreted according to their stated scope, actual publication information and validation status. These terms do not authorize fabricated evidence or misleading descriptions.
5. Editorial decisions, review and indexing
Submission does not guarantee external review, acceptance, publication timing, a DOI, indexing, citation performance, an award, a professional credential or a regulatory or immigration outcome. Manuscripts in the journal’s external peer-review track require at least two independent reviewers under the publication policy; article-level notices identify recorded review status. Review can reduce but cannot eliminate errors and is not a certification that all claims are correct. Editor-authored work requires independent handling. Database operators and registration agencies make their own decisions. ISSN or DOI identifiers are not represented as accreditation of the quality or truth of a work.
6. Fees and separately requested services
The journal charges no manuscript submission fees or article processing/publication charges (APCs). A free publication does not create a promise of acceptance. Requesting an expert assessment or applying to the board does not create a paid engagement, an appointment or an obligation for a particular person to act. If a separate service is ever proposed, its scope and any price must be expressly agreed in advance; no hidden charge is authorized by these terms.
7. Requests to named experts and board applications
The editorial office coordinates requests according to expertise, independence, conflicts and availability. Selecting a name identifies a preferred expert, not an assigned or committed reviewer. Any engagement and permission to share confidential material must be confirmed through the applicable process. Board applications are assessed under published criteria and do not confer membership, voting rights, employment, partnership or authority to represent the publisher. Individual scholarly opinions do not automatically constitute company endorsements.
8. Your submissions and communications
Provide only material you may lawfully share, including the necessary permissions for coauthor information, photographs, research data and third-party content. Keep copies of important documents and submission references. We may seek clarification, decline a request, restrict abusive access, or withhold public posting while addressing a rights or integrity concern. We do not promise publication of every submitted message. A confidentiality request should be raised before transmitting unusually sensitive material. These provisions do not prevent protected disclosures or good-faith complaints.
9. Corrections, withdrawals and rights complaints
Send concerns to the editorial office with the article URL, the specific statement or material at issue, an explanation and supporting evidence. Rights owners should identify the protected work, the challenged material and their authority to act, and provide a reply address. We may request declarations or information required by applicable law. This contact process does not claim that the publisher has registered a DMCA agent or that every statutory safe harbor applies. We assess corrections, expressions of concern, withdrawal and retraction according to the evidence, applicable law and preservation of the scholarly record. A complaint does not automatically establish wrongdoing or require removal, and these terms do not block court orders or statutory remedies.
10. Third-party systems and service availability
External websites, search engines, repositories, email systems and other providers operate independently. Linking to them does not guarantee their availability, accuracy, security or endorsement. We may modify or interrupt website functions for maintenance, security or operational reasons. Subject to the express commitments in our policies and applicable law, we do not guarantee uninterrupted access, a particular response time, complete data recovery or availability of every external resource. Maintain your own manuscript and research records.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND INFORMATIONAL CONTENT ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. We do not warrant that every error will be detected or that a publication is suitable for a reader’s particular project. This disclaimer does not override an express contractual commitment, our responsibility for our own representations, applicable data-security duties or a warranty that cannot lawfully be excluded.
12. Limitations of liability and mandatory exceptions
TO THE EXTENT PERMITTED BY APPLICABLE LAW, the publisher and its officers, employees, editors and authorized contributors are not liable under this agreement for indirect, consequential, special or punitive loss, lost business opportunities or lost profits arising from use of the website or informational content. For claims to which a contractual cap may lawfully apply, the aggregate contractual liability of those parties is limited to the greater of US$100 or the amount paid by the claimant to the publisher for the particular service giving rise to the claim in the preceding twelve months. This is an allocation of contractual risk, not a statement of immunity. Nothing excludes or limits fraud, intentional misconduct, gross negligence where non-excludable, liability for death or personal injury that cannot be limited, applicable statutory privacy or consumer remedies, or any other liability or remedy that the law does not permit us to exclude. It does not excuse breach of obligations that cannot lawfully be waived. If a provision is not enforceable for a particular claim or jurisdiction, the applicable legal rule controls that claim.
13. Limited responsibility for third-party claims
Where permitted by law, a submitting party agrees to reimburse reasonable, documented losses from a third-party claim to the extent caused by that party’s unauthorized submission of protected material, knowingly false material representations of rights or authority, or unlawful conduct. This obligation does not cover the publisher’s own negligence, wrongful conduct, unauthorized changes or breach of its own obligations. The publisher must give reasonable notice and an opportunity to participate in the defense; no settlement imposing admissions, ongoing obligations or nonmonetary restrictions on the submitting party may be made without that party’s consent. Mandatory consumer protections prevail. Honest criticism, a rights request or a good-faith complaint alone does not trigger this provision.
14. Applicable law, disputes and preserved rights
Subject to nonwaivable law, these terms are governed by Florida law without applying conflict-of-law rules. For disputes that may lawfully be assigned to an agreed forum, the parties agree to courts of competent jurisdiction in Sarasota County, Florida, or the appropriate federal court in the Middle District of Florida. This does not deprive a consumer or other protected person of a mandatory local forum or legal protection. These terms do not impose mandatory arbitration, waive a jury or class proceeding by implication, prohibit truthful reviews, restrict reporting to authorities or penalize lawful criticism. You may contact the editorial office to try to resolve a concern, but doing so is not a bar to remedies that cannot lawfully be conditioned on that step.
15. Electronic records, changes and contact
Required checkboxes are not preselected. When you affirmatively accept a form agreement, the journal records the document version, source-document hashes, submission reference, stated identity and acceptance time with that request. These records show the recorded action; they do not independently verify identity or coauthor authority. You may save or print the linked documents, request a copy of your agreement record, or contact the editorial office before agreeing to discuss a non-electronic alternative. A future document revision does not retroactively establish acceptance for an earlier article or request. Prior versions remain available. If a clause is invalid, the remaining clauses apply only to the extent they can lawfully operate. Contact: SHLAEN RETAIL LLC, 935 N Beneva Rd, Ste 609, PMB 2038, Sarasota, FL 34232, United States.
